MONTHLY HOA FEES & LATE FEES
Your association dues payment is due even if you do not receive a billing statement. These dues are essential in order to maintain our reserve funds and to complete repairs and improvements to common areas as soon as possible, all for the benefit of owners/residents and our community. Our collection policy is strictly enforced for the aforementioned reasons. If you feel there is an accounting error, please put your request in writing and mail to Spectra Associates.
Collection Policy for Comenzar de Nuevo HOA as of September 11, 2006.
Day 1 Assessments are due on the 1st day of the month.
Day 15 Assessments are late 15 days after they are due. At this point, the association will charge an additional fee of $25.00
Day 30 If the assessment is still not paid, the association will charge 12% per annum Civ.Code 1366(e)(3)
Day 45 At this point, the association may collect the assessment, late fees, interest and all costs of collection by filing a small claims action. Civ. Code 1367.4(b) (1) and/or the account may be turned over for collection and a demand letter sent to the delinquent owner by registered mail. The board will confer with the delinquent owner if the owner makes a proper written request
The Association may proceed to record a lien and will begin foreclosure when the due amount is at least $1800.00 or the delinquency is at least 12 months old. Civ.Code
1367.4 (b)(2) . Prior to recording a lien, the board must vote to authorize the lien at an open meeting. The vote must be recorded in the minutes of the meeting. The minutes may not disclose the name of the delinquent owner and can only refer to the address by lot/tract number or the assessor’s parcel number. Civ.Code 1367.1(a)
